Supreme Court Nixes Crush Act as Unconstitutional


In its Tuesday ruling in U.S. v. Stevens, the U.S. Supreme Court permanently struck down the “Crush Act,” a 1999 federal law banning the creation, sale and possession of materials depicting genuine acts of animal cruelty. In the majority opinion written by Chief Justice Roberts, the court attributed its decision to the law being both unconstitutional and overbroad.

The Crush Act was designed to stop the commerce of crush videos and other depictions of illegal acts of animal cruelty “in which a living animal is intentionally maimed, mutilated, tortured, wounded, or killed.” The act depicted did not have to be illegal where it was filmed, only where the resulting product was sold. Stevens, who marketed videos of dog and hog-dog fighting—some of which he filmed overseas—was the first person convicted under the Crush Act....

Although this verdict is disappointing, there is good news on the horizon. The Supreme Court left the door wide open for new, more narrowly drafted legislation to specifically target crush and animal fighting videos—and there is already interest on Capitol Hill in getting such legislation passed. The ASPCA will gladly work with Congress to draft new language that can withstand tests of constitutionality to provide law enforcement with the tools to effectively combat extreme animal abuse.

Thanks Brooke, for the Animal Haven link with the photos of the adorable MO puppies. So glad they were rescued. My gratitude also for the pilots who apparently donate their time and money to fly these dogs to NY.

Thank you for sharing that, Dianne. I noticed on my last visit to Animal Haven that they actually had rescued puppies from a high-kill municipal shelter in Missouri. These are the puppies, they were all so sweet!! http://ah.convio.net/site/News2?page=NewsArticle&id=6401&ne...

There's no need to buy from a puppy mill and support abuse and neglect when there are sweet dogs like these who need good homes.

Missouri is home to some 3,000 puppy mills, earning the nickname, "Puppy Mill Capitol of America ." Puppy mills are large-scale commercial dog breeding operations where profit is given priority over the well-being of the dogs. The overcrowding and lack of basic hygiene, veterinary care and exercise that are the hallmark of puppy mills create puppies with numerous health and social issues—but it is the breeding dogs, the ones who never get to leave, who suffer the most.

However, help is on the way! Missourians for the Protection of Dogs—a coalition made up of the ASPCA, the Humane Society of the U.S., the Humane Society of Missouri and the Missouri Alliance for Animal Legislation—is sponsoring a landmark ballot initiative to put the Missouri Puppy Mill Cruelty Prevention Act before the state’s voters in November 2010. While you can't sign the petition for the ballot initiative in Missouri, do your part and don't patronize pet shops or breeders. Save a wonderful, loving dog from being euthanized and adopt your next friend from a shelter or rescue group. All of the major breeds have rescue groups if you would desire a particular breed.

It looks like Casey puppy has a great home! She is even allowed to be up on the bed! Her doggie friend is adorable too! Thanks Animal Haven for doing such a great job in getting these dogs placed in happy homes!

I saw that Brooke mentioned The Animal Rescue Site, which donates money to shelters each time you visit. There is a similar application on Facebook called Save a Dog where you can virtually "foster" dogs and earn points that help feed real shelter dogs. Save a Cat also exists for cat people :)
